Bail in MarylandIf you are arrested in Maryland, there are three main ways you can get bailed out or released: release on recognizance, cash bond, or surety bond (with a bail bondsman). In certain situations, the commissioner or judge will allow a client to be released without posting bond. This is what happens on “ROR”. Release without posting bond happens more frequently on less serious charges and/or cases with clients who have close ties to the community and that are not a flight risk.Cash Bond. Cash bond is just like it sounds. Whatever your cash bond amount is is exactly the bond you will have to pay to get out of jail. If your cash bond is $500, it takes $500 to get your out of jail.Surety Bond (bail bondsman). A surety bond is a bond where the court will allow a surety (bail bondsman) to guarantee that you come to court. Surety bonds are bonds set in higher amounts than cash bonds. For example, let us say you have a $10,000 surety bond for theft of property. If you can afford to post 10% of that bond, a bail bondsman will take $1,000 of your money and sign for you to get out of jail. If you fail to appear for court the bondsman must produce you for court or forfeit the full $10,000. The upside for a client is that a client can get out of jail without having to post the full amount.
