What is Disorderly Intoxication Maryland?

Disorderly Intoxication law is under Md. Code, AB§ 6-320.

If you go to trial, the prosecutor must prove beyond a reasonable doubt that:
(1) you were intoxicated and endangered the safety of another individual or property; or
(2) that you were intoxicated or consumed an alcoholic beverage in a public place and caused a public disturbance.

This is an either-or; they do not have to prove both.

The Penalties for Maryland Disorderly Intoxication

The penalties for Maryland disorderly intoxication are found under Md. Code, AB§ 6-320(b) are that you will be guilty of a misdemeanor, can get up to 90 days in jail, or a fine of $100, or both.

Any conviction on your record can impact your future. Specifically, it can affect your attempt at future employment or in getting various security clearances.

What are the Defenses for Disorderly Intoxication?

The primary defense is to prove you were not intoxicated. If you get a DUI or DWI, the officers will give you a breath test or a field sobriety test to prove intoxication. Often, they don’t take the time to do this for disorderly intoxication offenses. This is a line of defense you should continuously pursue, and we pursue it in these types of cases.

It would be best if you also mounted a defense that you did not put someone else in physical danger or that your statements did not amount to a public disturbance. You have a First Amendment right to free speech, so any public disturbance must be balanced against your right to speak publicly.
